By accessing or using the Website, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Website.
These Terms apply to your use of the Website only. Clinical services provided by MMM are governed by our Services Policy. The collection and use of your personal information is governed by our Privacy Policy. Both are available on the Website and are incorporated by reference into these Terms.
2. Description of Website
The Website provides information about Midlife Metabolic Medicine, its clinical approach, provider credentials, service offerings, and educational content related to metabolic health, hormonal health, weight management, and perimenopause. The Website also provides access to scheduling tools (via Practice Better), a metabolic health quiz (via ScoreApp), webinar registration, downloadable educational resources, and email newsletter subscription (via HubSpot).

THE WEBSITE CONTENT IS FOR INFORMATIONAL AND EDUCATIONAL PURPOSES ONLY. This includes the substance of live webinars and educational events delivered by the provider to non-patient audiences; educational content remains educational regardless of the clinical expertise of the presenter or the specificity of the subject matter. Website content is not a substitute for professional medical advice, examination, diagnosis, or treatment by a qualified healthcare provider.
You should not rely on any information on this Website to make decisions about your health. Quiz results provided through the metabolic health quiz on this Website are for educational and self-assessment purposes only. They do not constitute a clinical evaluation, diagnosis, or treatment recommendation. Quiz results are not reviewed by a healthcare provider and do not establish a provider-patient relationship.
If you think you may have a medical emergency, call 911 or go to the nearest emergency department immediately. Do not use this Website, the patient portal, or any messaging feature to seek help for a medical emergency. MMM does not provide emergency medical services.
4. No Provider-Patient Relationship Through Website Use
Accessing this Website, reading its content, completing the metabolic health quiz, registering for a webinar, downloading a resource, subscribing to the email newsletter, or submitting a contact inquiry does not establish a provider-patient relationship with Midlife Metabolic Medicine or its provider, Denise Erland, FNP-C, FMACP.
A provider-patient relationship is established only when you complete a Metabolic Evaluation intake appointment through Practice Better and the provider accepts you as a patient. The free Discovery Visit is an introductory conversation to determine clinical fit and does not establish a provider-patient relationship for treatment purposes.
5. Intellectual Property
5.1 Website Content
All content on this Website — including text, graphics, logos, images, audio, video, page layout, and design — is the property of Revolution Health Alliance, PLLC, doing business as Midlife Metabolic Medicine, or its content providers and is protected by United States copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, or transmit any content on this Website without our prior written consent, except that you may print or download one copy of any page for your own personal, non-commercial, informational use.
5.2 Trademarks
The name “Midlife Metabolic Medicine,” the MMM logo, “Metabolic Rebuild,” “Metabolic Evaluation,” “Adaptive Defense Model,” “Active Continuity,” “Continuity Care,” and the tagline “A provider as serious as you are” are trademarks or service marks of Revolution Health Alliance, PLLC, doing business as Midlife Metabolic Medicine. You may not use these marks without our prior written consent.
5.3 Clinical Framework
The Adaptive Defense Model — including its five principles, three-phase clinical timeline, and clinical logic structure — is the proprietary intellectual property of Revolution Health Alliance, PLLC, doing business as Midlife Metabolic Medicine. The ADM represents the provider’s original synthesis and sequencing of evidence-based clinical principles. It is not a patented method or a peer-reviewed research protocol. The intellectual contribution is the synthesis, sequencing, and clinical application. You may not reproduce, teach, present, distribute, or create derivative works from the Adaptive Defense Model or its components for commercial purposes without our prior written consent. This prohibition includes repackaging, renaming, or adapting the ADM framework or its structural elements (the five-principle sequence, the three-phase timeline, or the clinical logic of sequencing interventions based on individual evaluation results) for use in another commercial healthcare practice, program, course, or publication.
6. User Conduct
When using this Website, you agree not to:
• Use the Website for any unlawful purpose or in violation of any applicable local, state, or federal law.
• Attempt to gain unauthorized access to any portion of the Website, other accounts, computer systems, or networks connected to the Website.
• Use the Website to transmit any advertising, promotional materials, spam, or other form of solicitation.
• Use any automated system, including bots, crawlers, or scrapers, to access the Website for any purpose without our prior written consent.

8. Webinar and Educational Content
MMM offers live webinars and educational content through the Website. Webinar content is for educational purposes only and does not constitute medical advice. Webinar content is the intellectual property of Revolution Health Alliance, PLLC, doing business as Midlife Metabolic Medicine. Recording, rebroadcasting, or redistribution of webinar content without prior written consent is prohibited.
Webinar registration through ScoreApp and email communications through HubSpot are subject to the terms and privacy policies of those platforms. By registering for a webinar or subscribing to email communications, you consent to receive communications from MMM as described in our Privacy Policy. You may opt out of marketing communications at any time.
9. Downloadable Resources
MMM may offer downloadable educational resources (such as PDF guides) through the Website. These resources are provided for your personal, non-commercial use only. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, MMM, ITS PROVIDER, AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE WEBSITE OR WEBSITE CONTENT.
This limitation applies to claims arising from reliance on Website Content for personal, wellness, or health-related decision-making; any third-party content, links, products, or services accessed through the Website; and any interruption, delay, error, or cessation of the Website. “Website Content” includes educational and informational content made available through or promoted by the Website, including webinars, recorded presentations, quizzes, downloadable resources, newsletters, and email communications provided to non-patients. Such content is educational only and is not clinical care, medical advice, diagnosis, or treatment.
To the fullest extent permitted by law, MMM’s total liability for any claim arising solely from non-clinical access to or use of the Website or Website Content will not exceed the greater of (a) $100 or (b) the amount you paid, if any, for the specific non-clinical Website-related product or service giving rise to the claim during the 12 months preceding the event giving rise to the claim.
Nothing in these Terms limits or excludes liability arising from the provision of, or failure to provide, professional healthcare services, including any claim for professional negligence, malpractice, lack of informed consent, or any matter incidental or related to the provider-patient relationship. For the avoidance of doubt, no Website term applies to or limits claims by enrolled patients arising from clinical evaluation, diagnosis, treatment, prescribing, monitoring, follow-up, or other professional services.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for willful misconduct or gross negligence to the extent such liability may not lawfully be limited.
13. Indemnification
You agree to indemnify and hold harmless Revolution Health Alliance, PLLC, doing business as Midlife Metabolic Medicine, and its provider from and against third-party claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of your use of the Website in violation of these Terms or your violation of any third-party rights. This indemnification obligation does not apply to claims arising from clinical care, the provider-patient relationship, or any act or omission by MMM, and does not require you to assume the defense of any claim.
14. Governing Law and Jurisdiction
These Terms and any dispute arising out of or relating solely to your access to or use of the Website are governed by the laws of the State of Idaho, without regard to its conflict-of-laws principles. Any legal action arising out of or relating solely to these Terms or your non-clinical use of the Website shall be brought exclusively in the state or federal courts located in Ada County, Idaho, and you consent to the personal jurisdiction of those courts.
Before either party files suit, the parties will first attempt in good faith to resolve the dispute informally by written notice. If the dispute is not resolved within 30 days, either party may request non-binding mediation to be conducted remotely or in Ada County, Idaho, before proceeding to court.
This section applies only to non-clinical Website disputes. Any dispute arising from professional healthcare services, the provider-patient relationship, or clinical care is governed by the applicable patient-facing agreements, services policies, and governing law applicable to those services, not these Terms.
15. Severability
If any provision of these Terms is held to be unenforceable or invalid by a court of competent jurisdiction, that provision will be enforced to the maximum extent permissible, and the remaining provisions of these Terms will remain in full force and effect.
16. Entire Agreement
These Terms, together with the Privacy Policy and Services Policy, constitute the entire agreement between you and MMM regarding your use of the Website. These Terms supersede any prior agreements or understandings regarding the Website. For enrolled patients, the clinical relationship is additionally governed by the informed consent and any agreements executed through Practice Better, which supplement but do not replace these Terms.
17. Changes to These Terms
We may update these Terms from time to time. When we make changes, we will update the “Last Updated” date at the top of this page. Your continued use of the Website after any changes constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you should discontinue use of the Website.
